RULES, NOT LEGAL ADVICE
Schedule III and SAFE Banking did not finish the cash question
Market · Schedule III, SAFE Banking, cash · 2026-10-28
Dispensary owners ask whether federal changes in 2026 removed the reason to think about cash. The published rules are narrower than that hope. This page is not legal advice.
What the April 2026 order covers
A DEA final rule in the Federal Register, effective April 28, 2026, places FDA-approved drug products containing marijuana, and marijuana covered by a state medical marijuana license, in Schedule III. The Justice Department announced the order on April 23, 2026 and said a separate hearing on broader rescheduling would begin June 29, 2026.
The DEA described that hearing as scheduled to start on June 29, 2026 and to conclude not later than July 15, 2026, with room for the judge to continue it. As of October 28, 2026, this site does not treat a broader move of marijuana off Schedule I as a completed rule. Adult-use retail is not the same thing as a state medical marijuana license. Do not read the April order as a statement that every New Jersey adult-use dispensary is now in Schedule III.
SAFE Banking was a bill, not a law
Congress.gov listings reviewed on October 28, 2026 showed the SAFE Banking Act of 2026 as H.R. 9471, introduced June 25, 2026, with a latest action of July 17, 2026 referral to the House Subcommittee on Economic Opportunity. S. 4942 was introduced June 24, 2026 and referred to the Senate Committee on Banking, Housing, and Urban Affairs. Those listings did not show either bill becoming law.
This site does not claim that banks refuse every dispensary, and it does not claim that a bank account is impossible. It also does not claim that a pending bill has changed how your store takes payment. Customers who want cash still need a place to get it. An on-site ATM is that place. It is not a substitute for your own banking or compliance advice.
What we will and will not say
U.S. Payments is not a bank and does not offer a sponsor-bank relationship on this website. Full-service placement supplies the cash inside the ATM for a qualifying dispensary. That is a practical answer to a full machine, not a comment on federal drug scheduling.
For the New Jersey license picture, use the CRC pages linked from our county guides, then call your attorney or compliance advisor for the legal reading. Call us at 973-452-4131 for the ATM.
Questions from dispensary operators
Did marijuana move to Schedule III for adult-use dispensaries?
The April 28, 2026 final rule covers FDA-approved marijuana products and marijuana under a state medical marijuana license. This site does not describe adult-use retail as fully rescheduled. A broader hearing was scheduled for June 29, 2026, and no final result is stated here.
Is the SAFE Banking Act law?
Not based on the Congress.gov listings reviewed October 28, 2026. H.R. 9471 and S. 4942 had been introduced and referred to committee. They had not been shown as enacted.
